While our client was riding his motorcycle northbound on State Road 37 in Johnson County, Indiana. At that same time and place, a driver in the course of his employment in a Chevy Silverado owned by his employer, carelessly and negligently failed to yield the right-of-way, turning directly into the path of our client's motorcycle. As a result, our client was unable to avoid colliding head first with the mid-section of the truck. Upon impact, our client was ejected from the motorcycle and thrown to the pavement where he was then run over by another vehicle traveling northbound.

Liability in this case was clear, and the driver of the Chevy Silverado was cited by the Johnson County Sheriff's department for failure to yield the right-of-way at a through highway. Because the driver of the Silverado truck was in the scope of his employment at the time of the collision, his company was vicariously liable for his negligent acts.
