Recovery for Passenger’s Wrongful Death Caused by an Intoxicated, Uninsured Driver
A twenty-one year old (21) female was a passenger in a vehicle driven by an uninsured driver. The uninsured driver was traveling northbound on McCormick Road and failed to make a curve to the west, ran off the north side o f the roadway, and struck a utility pole on the passenger side of his vehicle. The female passenger died instantaneously of multiple blunt force traumas to her head. It was determined that the driver was intoxicated at the time of the collision. With Representation from Tabor Law Firm, the passenger who was killed in the collision submitted a wrongful death claim to The Hartford under the uninsured provision of their own policy of insurance and recovered the six-figure uninsured policy limits available under their automobile insurance policy.
