Case Study
Martinez v. Verkler, Inc., Hagerman Construction Corporation, and Hagerman Inc.
On August 16, 2005, David Martinez was ascending an on-site ladder from the ground floor to the Unit F Mezzanine level, when the ladder kicked out from beneath him causing David to fall. David was reportedly near the top of the ladder when the bottom of the ladder kicked back. This caused the ladder and David to fall to the concrete floor below. David landed both on the ladder and on the concrete floor. The ladder did not extend the required minimum three (3) feet above the mezzanine level, and it was not tied off or secured at the time David attempted to ascend it to the mezzanine where he was directed to work. Additionally, the ladder's feet were standing in water and muck. Moreover, the stanchions and guardrail wire, which protected employees at or near the edge of the mezzanine, had been removed some 5 days prior to the incident according to Mark Henry, one of David's co-workers. No other fall protection was provided for those at or near the mezzanine. As a result of his fall from the ladder, David sustained rib and elbow factures, lacerations, contusions, knee and foot displacement, and nerve damage. Mr. Martinez sustained permanent deformaties and required multiple surgeries and therapy sessions. David Martinez incurred partial impairment, large medical expenses and lost wages.
