Smith v. Barmet Industries

On May 19, 1984, Novice Smith was in the scope of his employment, working at a plant in Warrick County, Indiana. Mr. Smith was working with a with a product that was designed, and manufactured by Barmet Industries, Inc. and Barmet of Indiana, Inc. He was in the process of using the product in conjunction with a remelt furnace. Suddenly and without warning an explosion occurred and Novice Smith was killed as a result. Barmet Industries, Inc. and Barmet of Indiana, Inc. denied any liability for the incident. Through thorough and exhaustive investigation, Tabor Law Firm showed that there was a defect in the product manufactured by Barmet Industries, Inc. and Barmet of Indiana, Inc. that caused the explosion and that the Defendants were careless and negligent in the designing, manufacturing, processing, testing, inspection, distribution and selling of the product that was being used by Mr. Smith. Further, Tabor Law Firm showed the negligence of the Defendants proximately caused the death of Mr. Smith.
