What is a Deposition?

A deposition is a testimony taken down in writing under oath. In most personal injury cases, the deposition will be an out-of-court testimony under oath, taking place in an attorney’s office or conference room.


If you file a personal injury lawsuit, you may be told to attend a deposition. At this deposition, the defendant’s attorney will ask you questions about your accident and injuries you incurred.

A deposition can be very useful. It allows both sides to hear each others version of the accident and then better assess strengths and weaknesses of the case. This can help attorneys and their parties determine if they should settle or proceed to trial.
